The Government of Ghana has issued a firm directive enforcing strict Ghanaian participation rules in the extractive sector, declaring that all underground contract mining operations in the country must involve an indigenous company holding at least a 50 per cent equity stake.

The mandate, spearheaded by the Ministry of Lands and Natural Resources and the Minerals Commission, aims to deepen local content implementation, retain maximum economic value within the domestic economy, and ensure local entities play an active role in high-value mining operations.

Under the regulatory framework, while surface or open-pit contract mining requires 100 per cent Ghanaian ownership, deep-level underground contract mining permits joint ventures provided indigenous firms hold a controlling or equal equity interest of no less than 50 per cent, along with directorship representation.

Reaffirming the policy direction, official state directives emphasized that compliance with local content laws remains non-negotiable for all operating mining entities across the country.

“The government has reaffirmed the requirement for Ghanaian participation in contract mining, directing that underground mining operations undertaken through contract arrangements must involve a Ghanaian-owned company holding at least a 50 per cent interest,” statement excerpts highlighted.

Addressing concerns surrounding the transition and labor protections, state regulators reassured industry stakeholders that local equity regulations would be matched with strict supervisory oversight to safeguard workers’ welfare and prevent operational disruptions.

“The government remains committed to promoting transparency, genuine Ghanaian participation, and the protection of workers as the contract mining policy is implemented,” the regulatory authority affirmed.

The enforcement drive aligns with wider national targets to maximize value retention across the mineral supply chain and incentivize local commercial banks to finance high-capital extractive projects.

Mining companies and sub-contractors operating within underground concessions across key mining belts are expected to align their ownership structures immediately or face regulatory sanctions.
