    President John Dramani Mahama has stated that the Presidency has completed its part in the process of suspending Chief Justice Gertrude Araba Esaaba Sackey Torkornoo, and now awaits the findings of the investigative committee established to probe the claims against her removal.

    Speaking at the Jubilee House on July 7, 2025, Mahama described the predicament as “difficult” and thanked the Council of State for their involvement.

    He emphasized that his administration has acted within the bounds of the Constitution and that future actions will be guided by the committee’s report.

    “We’ve done our part. The rest is left with the committee that was set up to come out with whatever its findings are, and based on that, whatever the consequential issues are, will be dealt with,” Mahama said.

    Meanwhile, Chief Justice Torkornoo has taken her case to the ECOWAS Community Court of Justice in Abuja, Nigeria, alleging human rights violations stemming from her suspension.

    Her lawyers argue that the suspension effectively removed her from office without due process, violating her constitutional rights.

    The committee’s report is expected to determine whether Chief Justice Torkornoo will be reinstated or permanently removed from office. The suspension has sparked intense squabble, with concerns raised about the implications for judicial independence.

    Suspended Chief Justice Gertrude Araba Torkornoo has instituted legal proceedings against the Government of Ghana at the ECOWAS Community Court in Abuja, Nigeria, contesting her suspension from office. Confirming the development, Deputy Attorney General Justice Srem Sai stated,

    “I can confirm that the Chief Justice – Her Ladyship, Justice Gertrude Torkornoo – has filed another court case – this time, at the ECOWAS Community Court in Abuja, Nigeria, against the Republic.”

    The lawsuit, filed on July 4, underscores the Chief Justice’s assertion that her suspension constitutes a palpable infringement on her fundamental human rights. Notably, these allegations mirror claims currently pending adjudication before Ghana’s apex court and the High Court, respectively, in relation to the ongoing impeachment proceedings.

    Justice Srem Sai further elucidated that Her Ladyship posits that her suspension has, in effect, precipitated her removal from office sans a definitive determination, thereby compromising her constitutional mandate and right to hold office.
